Terms of Use

These Terms of Use ("Terms") govern your access to and use of wayofyawara.com (the "Site"), operated by 941 Apps, LLC, a California limited liability company ("we," "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. The Site is a journal

The Site publishes a personal training journal and related commentary. As described in the Disclaimer, which is incorporated into these Terms, nothing on the Site is professional instruction or advice of any kind, and no professional or advisory relationship is created by your use of the Site.

2. Assumption of risk

Martial arts, including Brazilian jiu-jitsu, involve inherent and serious risks, up to and including catastrophic injury and death. You agree that you will not rely on the Site for training decisions, that any physical activity you undertake is at your sole risk, and that you will seek qualified, in-person instruction and medical clearance appropriate to your circumstances.

3. No warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 941 APPS, LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS (INCLUDING THE AUTHOR) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR RELIANCE ON ANY CONTENT. WHERE LIABILITY CANNOT BE EXCLUDED, TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, the above applies to the fullest extent permitted.

5. Intellectual property

Site content (text, design, and the 柔 mark as used here) is owned by 941 Apps, LLC or its licensors. You may share links and brief quotations with attribution; you may not republish substantial portions without written permission. "Way of Yawara" and the Site's trade dress may not be used to imply affiliation or endorsement.

Posts containing affiliate links or sponsored content are marked on the post. The Site may in the future offer goods, applications, or services; additional terms will be presented at that time and will govern those offerings. Third-party sites linked from the Site are not under our control, and we are not responsible for their content or practices.

7. Indemnity

You agree to indemnify and hold harmless 941 Apps, LLC and the author from claims arising out of your breach of these Terms or your misuse of the Site or its content, including any attempt to perform activities described on the Site.

8. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Exclusive venue for any dispute lies in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

9. Changes

We may update these Terms by posting a revised version with a revised date. Continued use of the Site after changes constitutes acceptance.

10. Language

Translations of the Site are provided for convenience. If any translated version of these Terms differs from the English version, the English version controls.
